Veteran Discrimination for PTSD
A jury awarded $405,083 to a veteran with disabilities in a case for disability discrimination in St. Petersburg, Florida. The Equal Employment Opportunity Commission (EEOC) announced the Suit against The Princess Martha senior living facility, which is managed by TJM Property Management and TJM Properties INC.
The facility and management violated federal law by denying accommodations for veterans and refusing to hire them when applying for a job at Princess Martha. The EEOC admitted evidence that the applicant shared with the hiring manager that she was a veteran with PTSD and takes medication to treat the condition. But this medication would cause her to fail her drug test. Soon after sharing this information with the hiring manager and the Princess Martha Facility, she took the drug test as required and continued to show proof of her medications.
The Facility showed no mercy and revoked her job offer. A manager from the facility admitted that they submitted false information to the EEOC. This is a violation of the Americans with Disabilities and the EEOC filed suit against the facility, The Princess Martha Senior Living Facility. The jury concluded a unanimous verdict finding that the applicant was denied accommodations throughout her application process because of her disability.
There should be no reason that anyone with any sort of disability is deprived of an opportunity to work, especially when they a providing proof of the condition. The Princess Martha Senior Living Facility and the TJM entities denied the rights of this applicant and violated her rights under the ADA.
